Welcome to CheckPage, a website monitoring and testing service operated by Leaf Computer Corporation ("we," "us," or "our"). By accessing or using CheckPage (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

You must be at least 18 years old or the legal age of majority in your jurisdiction, whichever is higher, to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Description of Service

CheckPage provides website monitoring, uptime checking, and automated testing services. The Service allows you to:

• Monitor websites for certain issues
• Run automated tests on your web pages
• View reports about your monitored websites

The Service is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted access to the Service or the accuracy of monitoring results. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. User Accounts

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Monitor websites that you do not own or have explicit permission to monitor
• Monitor websites that contain adult, illegal, or otherwise objectionable content
• Use the Service to engage in any illegal, fraudulent, or abusive activity
• Attempt to interfere with, disrupt, or breach the security of the Service
• Use the Service to transmit spam, malware, or other harmful code
• Attempt to gain unauthorized access to other users' accounts or data
• Use the Service in any way that could damage, disable, or impair our infrastructure
• Use automated systems to access the Service except through a provided API

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

5. Billing and Payments

Certain features of the Service require payment of fees. All payments are processed through our third-party payment processor, Polar. You agree to:

• Pay all applicable fees as described at the time of purchase
• Provide valid payment information
• Authorize us to charge your payment method for all fees incurred

Subscriptions and Renewals: Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. We will charge your payment method on file at the then-current rate.

Refund Policy: We offer a 7-day money-back guarantee from the date of purchase. If you are not satisfied with the Service, you may request a full refund within 7 days of your initial purchase. To request a refund within this period, please contact us. After 7 days, we generally do not provide refunds, but we may do so at our sole discretion on a case-by-case basis.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until that time.

We reserve the right to change our pricing and fees at any time. We will provide you with reasonable notice of any price changes. Your continued use of the Service after a price change constitutes your acceptance of the new pricing.

6. Intellectual Property

The Service, including all content, features, functionality, software, and design, is owned by Leaf Computer Corporation and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the websites you monitor and the data generated from your use of the Service. By using the Service, you grant us a limited license to access, store, and process your data solely for the purpose of providing the Service to you.

You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software without our express written permission.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAF COMPUTER CORPORATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any interruption or cessation of the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors, inaccuracies, or omissions in any content or monitoring results
• Any failure to detect website issues or downtime

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, for any reason including but not limited to:

• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Requests by law enforcement or government agencies

Upon termination, your right to use the Service will immediately cease. We will retain your data for 90 days after account deletion, after which it will be permanently deleted. You may request earlier deletion by contacting us.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Leaf Computer Corporation regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
